  Here is the official response from Trinity regarding legal advice concerning outstanding issues and monies from TW 'Steve I appreciate your concerns however I can only advise that Trinity are and will continue to act in the best interest of the residents of Holwood but beyond that I cannot comment on the financial situations of Taylor Wimpey. If there is general concern throughout the residents regarding TW’s then I would suggest the best course of action would be to seek legal advice but to what extent I am unclear. What he additionally said is that if the residents instructed Trinity to instigate legal proceedings against TW for recovery of money etc then Trinity would fulfil that request. For such action Trinity would require a written instruction signed by a majority of residents. The cost of the action would fall on the Community. It is my intention over xmas to start preparation of the papers needed to legalise the HERA as per the wishes of residents at our last gathering. That is my priority. Perhaps one of those persons that feels strongly that we should instigate legal proceedings would like to circulate residents to see if the majority view is to instigate legal action. I know Tony Tomlinson was strongly of this view but there were others as well! What do you all think? My personal view is that TW are not 'unwilling' but 'unable' to fulfil their obligations. If they get re-financed then we will get our money/works done. If they do not get re-financed then we will not. I am unsure what legal action might improve things. We could ask Trinity to send a letter saying that HERA are threatening legal action; I dont know whether that might help! It at least would not cost anything. Please air your views and also put yourself forward if you would like to organise or help with the canvassing to get the community view. Whatever is discussed here of course does not by any means preclude somebody from seeking their own personal legal advice. Kaz
